Terms of Reference for 7th Central Pay Commission approved by Union Cabinet today......

The Union Cabinet today gave its approval to the Terms of Reference of 7th Central Pay Commission (CPC) as follows:-

a)      To examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the emoluments structure including pay, allowances and other facilities/benefits, in cash or kind, having regard to rationalization and simplification therein as well as the specialized needs of various Departments, agencies and services, in respect of the following categories of employees:-

 i.    Central Government employees-industrial and non-industrial;
 ii.   Personnel belonging to the All India Services;
 iii.  Personnel of the Union Territories;
 iv. Officers  and   employees   of  the   Indian  Audit  and   Accounts Department;
 v. Members of regulatory bodies (excluding the Reserve Bank of India) set up under Acts of Parliament; 
and
     vi. Officers and employees of the Supreme Court.

b)      To examine, review, evolve and recommend changes that are desirable and feasible regarding principles that should govern the emoluments structure, concessions and facilities/benefits, in cash or kind, as well as retirement benefits of personnel belonging to the Defence Forces, having regard to historical and traditional parities, with due emphasis on aspects unique to these personnel.

c)      To work out the framework for an emoluments structure linked with the need to attract the most suitable talent to Government service, promote efficiency, accountability and responsibility in the work culture, and foster excellence in the public governance system to respond to complex challenges of modern administration and rapid political, social, economic and technological changes, with due regard to expectations of stakeholders, and to recommend appropriate training and capacity building through a competency based framework.

d)     To examine the existing schemes of payment of bonus, keeping in view, among other things, its bearing upon performance and productivity and make recommendations on the general principles, financial parameters and conditions for an appropriate incentive scheme to reward excellence in productivity, performance and integrity.

e)      To review the variety of existing    allowances presently available to employees in addition to pay and suggest their rationalization and simplification, with a view to ensuring that the pay structure is so designed as to take these into account.

f)       To examine the principles which should govern the structure of pension and other retirement benefits, including revision of pension in the case of employees who have retired prior to the date of effect of these recommendations, keeping in view that retirement benefits of all Central Government employees appointed on and after 01.01.2004 are covered by the New Pension Scheme (NPS).

g)      To make recommendations on the above, keeping in view:

i.          the economic conditions in the country  and need for fiscal prudence;
ii.   the need to ensure that adequate resources are available for developmental expenditures and welfare measures;
iii.     the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications;
iv.     the prevailing emolument structure and retirement benefits available to employees of Central Public Sector Undertakings; and
v.      the best global practices and their adaptability and relevance in Indian conditions.

h)To recommend the date of effect of its recommendations on all the above.

The Commission will make its recommendations within 18 months of the date of its constitution.  It may consider, if necessary, sending interim reports on any of the matters as and when the recommendations are finalised.

The decision will result in the benefit of improved pay and allowances as well as rationalization of the pay structure in case of Central Government employees and other employees included in the scope of the 7th Central Pay Commission.

Background

            Central Pay Commissions are periodically constituted to go into various issues of emoluments’ structure, retirement benefits and other service conditions of Central Government employees and to make recommendations on the changes required.

DA 10% from Jan'2014 -

Release of additional installment of dearness allowance to Central Government employees and dearness relief to Pensioners, due from 1.1.2014 


The Union Cabinet today approved the proposal to release an additional installment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.01.2014, in cash, but not before the disbursement of the salary for the month of March 2014 at the rate of 10 percent increase over the existing rate of 90 percent.

Hence, Central Government employees as well as pensioners are entitled for DA/DR at the rate of 100 percent of the basic with effect from 01.01.2014. The increase is in accordance with the accepted formula based on the recommendations of the 6th Central Pay Commission.

The combined impact on the exchequer on account of both dearness allowance and dearness relief would be Rs. 11074.80 crore per annum and Rs. 12920.60 crore in the financial year 2014-15 ( i.e. for a period of 14 months from January 2014 to February 2015).

Comrades,


         NFPE & AIPEU GDS (NFPE) union has taken a firm stand on the demand of inclusion of GDS in 7th CPC and pave the way for struggle to the last inch. You might have well aware that the traditional sentiment of GDS is departmentalization and civil servant status. Our union created history within a short span of time with effective struggles organizationally and proceed to the Apex Court legally to reach our goal. Our demands charter is never changed or modified.

            We had bitter experiences with all the Pay Committees in the past. One might not forget about the instances that took place at the time of Justice Talwar Committee and much more bitter experience with the next One Man Committee. How long it will continue to go for bitter experiences with GDS pay committees?

          We tried our level best to consolidate all unions in NFPE and in Confederation after enlightening the genuine demands of GDS cadre and convinced them to go for a unanimous understanding along with the issues of GDS  to consider in the ensuing Central Pay Commission. We became successful and our GDS demand has been included in the Terms of Reference of all Central Govt. Employees proposed to the Govt.

     Our prayers  
(i) Civil Servant status by implementing the Judgment (1977) of the Apex Court &
(ii)to scrap the GDS (Conduct & Engagement) Rules 2011 
-- have been accepted by the Supreme Court and the case is under process in Delhi High Court.  

         On the other side, this time all the Central Govt. employees’ sections are in support for our NFPE GDS Union to build pressure on the Govt. to accept the genuine demand of inclusion in 7th CPC. The Terms of Reference is still under consideration and for final decision.

           To our ill fate, hurried decision of the so call recognized union from the bitterness of their immature call for indefinite strike caused all the GDS in the country, emphasizingly claiming of their own union thrown in to dark future and decided to evolve another bad period till next Pay Commission.

Which is the right decision? (members can analyze .... !)

Whether to fight for inclusion in 7th Central Pay Commission?
Or
Whether reaching an agreement with the Department for separate pay committee? 
(an inappropriate way)

Whether demanding civil servant status in the ambit of 7th CPC?
Or
Whether continue with Conduct & Engagement Rules? 
(even a Judge for separate committee will consider only the previous committee’s recommendations under the policies of the Govt.)

          Instead of recollecting the past experiences and harsh situations faced for the last many years, the leadership of the so called recognized union exposing their impatience, intolerance, prejudices continuously and unfairly. They forget decency and decorum as they claim they are in higher forum.

            Some leaders are still in the opinion that they are only doing good by forgetting that which is good and what is the good to do. They are defending themselves that they have done good but the members know the quantum of good offered to the cadre.

          Destruction started from their side and destructed all that they want and remained as precipitate. Instead of reconstruction, they started obstruction to many as they are totally submerged. The nature of destruction is still stimulating them to go for a total destruction on their own with many contradictions.

           Totally deviating from the normal decency and common trade union policy, exposing themselves to all as a chattered one and not watching the words. Who is doing good and whether had done any good ….. now people are counting on them.

We does’nt want to make any confusion.

We will wait uncomplainingly; bear with any circumstances with all accepted facts.

Comrades,

               After reviewing the situation in all the circles, our CHQ is strongly protesting the agreement reached with AIGDS Union  for accepting a separate committee for GDS. The claim of representing the 2.63 lakh GDS by the so called recognized GDS union is a farce and the said indefinite strike is only partial and it could not reflect the decision for that union to reach an agreement with the Dept. betraying the ambitions and willfulness of the GDS for civil servant status and inclusion in 7th CPC.

            To our knowledge, never in the past, such an agreement was made by any union before announcing the pay commission. All are waiting for the decision on terms of reference proposed to the Govt. Decades after, all the Central Govt. employees including Railways, Defense came on one platform and with the successful efforts of the Confederation leaders and inclusion of the issues of GDS in 7th CPC  has been accepted and proposed in the terms of reference for 7th CPC.

               Railway federations & Defense federations wrote letters to the Govt. to include GDS in 7th CPC. One round of discussion was held with JCM leaders. Our Postal JCA (NFPE & FNPO) wrote to the Prime Minister and the letter is forwarded to the Department of Posts for their consideration. Confederation and FNPO conducted two days strike on 12th & 13th Feb on 15 point charter of demands including GDS demands. And the postal JCA has already decided to go an indefinite strike if the GDS are not included in the 7th CPC.

            In this background, the AIGDS Union started indefinite strike with their demands including the demand of ‘inclusion of GDS in 7th CPC’. But at the conclusion of their strike the General Secretary reached an agreement with the Dept. in such a manner attempting his right to claim the sentiment of all GDS for accepting a separate committee and deviated from their strike demand.

AIGDSU may accept it as a “respectful agreement”.  
What way it is respectful? Or it is respectable? to whom? by whom?
What it is the necessary to go to such agreement alone for one demand? 
What is the meaning in it? 
Can’t that Union question the Dept. where  it is proposed for a separate committee with retd. Judge as the CPC is also headed by a Judge, what is the necessity for two separate judge’s recommendations for the employees working in one Dept.? 
Even in the discussions held on 17-2-14, it is clearly mentioned to review the matter after the terms of reference decided by the Govt.,  
Further Dept. also wrote to DoP&T to include ‘GDS in 7th CPC becomes possible’. 
why showed necessary hurry to go for an agreement?

Reaching such an agreement is not a mandatory because the Govt. did not finalize the terms of reference and the decision of inclusion of GDS in 7th CPC is still pending and did not disclosed anywhere and anybody. The Dept is not yet concluded its decision for constituting a separate committee for GDS.

               The so called respectful agreement is only to skip off from their indefinite strike as it is proved a fragmented one, the response to the said strike is recorded only 25% (average) all over India. 
          Or any other threatening  by the administration or any obligation with the department?
               We doubt that the AIGDS union has no other chance to go further struggles on this issue and decided to conclude like this by creating confusion among the GDS.
                 At the time of last pay commission (6th CPC) also, all the postal organizations decided to boycott the officer’s committee, Com.Mahadevaiah followed his independent  & unilateral decision and accepted it which resulted in the modified rules denying civil status to GDS and kept them separate with GDS Conduct & Engagement Rules. 
              This time also he deviated from the general concept of the cadre and bows his head before the Dept. and reached with such agreement by leaving all the GDS in chaos.
              Again he wrote to the department claiming the inclusion of terms of reference as was proposed for 7th CPC. How funny? Are all GDS are innocent and unaware of the tactics of that leadership?

              AIPEU GDS (NFPE) & NEPF along with FNPO continues our struggle to the last mile to include the GDS in 7thCPC. The details of all our programmes will be intimated from time to time.

CONFEDERATION LEADERS STAGED DHARNA IN DELHI ON 15 POINT CHARTER OF DEMANDS & INCLUSION OF GDS IN 7th CPC

POLICE REFUSE PERMISSION TO CONDUCT DHARNA ON THE SECOND DAY.

As per the decision of the National Secretariat of the Confederation of Central Government Employees & Workers a mass dharna was conducted at Jantar Mantar (Parliament Street) New Delhi, to protest against the negative attitude of the UPA Govt. and Finance Minister Shri P. Chidambaram towards the 15 point charter of demands of the Central Government Employees, including DA merger, Interim Relief, inclusion of GDS under 7th CPC, Date of effect 01.01.2014 etc. Even in the Budget (Vote on account) presented by the Finance Minister in Parliament there is no mention about any of the Central Govt. Employees demands.

Even though the dharna was scheduled for two days; it was concluded in the first day evening itself, as the Delhi Police denied permission for the Second day.(See Police Order below)Com. KKN Kutty, National President of the Confederation inaugurated the dharna. He declared that Confederation has decided to go fo an indefinite strike, immediately after election, if the Govt. is not ready to concede our demands. He congratulated all the Central Govt. Employees who made the Feb 12th & 13th two days strike a thundering success. National Convention of  the Confederation scheduled to be held at Nagpur on 4th April 2014, will decide the future course of action and also strike programme.

“DEATH WARRANT FOR 2.76 GRAMIN DAK SEVAKS” - signed by the GDS recognised union

IN THE TERMS OF REFERENCE OF SEVENTH PAY COMMISSION.
 
MAHADEVAIAH SIGNED THE DEATH WARRANT OF 2.76 LAKHS GRAMIN DAK SEVAKS. HE WANTS TO KILL THE CHILD EVEN BEFORE ITS BIRTH.

Recognised union (Mahadevaiah) accepted the stand of the Government and Postal Board that GDS are NOT Government employees (Civil servants) and hence they cannot be included in the Seventh Pay Commission which is for Government Employees.
 
Government and Postal Board cleverly managed Mahadevaiah to sign a written agreement accepting their stand, so that he cannot go back from the agreement again.

All organizations in the staff side, JCM National Council including Railways, Defense, Confederation, NFPE & FNPO has taken a firm stand that we will not accept separate committee (Whether separate Judge or Bureaucrat) for GDS this time and GDS should be included in Seventh CPC itself. Recognised GDS union leader (Mahadevaiah) became an Agent of the government and signed Agreement accepting the Government’s stand. Mahadevaiah admitted that GDS are not civil servants and hence a separate committee is enough.
 
NFPE & FNPO and also the GDS unions of NFPE (AIPEU-GDS-NFPE) & FNPO (NUGDS) strongly condemn and protest against the foul play and treachery of Mahadevaiah and Postal Board.
 
Hold Protest Demonstrations in front of all offices on 26.02.2014 demanding cancellation of the agreement and inclusion of GDS in the 7th Pay Commission itself.
 
Dear friends and Comrades,

All of you are aware that all the Unions and Federation of the Staff Side, JCM National Council including Railways, Defense, Confederation, NFPE & FNPO have taken an unanimous stand that Gramin Dak Sevaks of the Department of Posts should be included in the 7th Pay Commission and we will not accept any separate Committee (Whether Judge or Bureaucrat) for GDS. This is the first time the entire JCM (Staff Side) including Railways and Defense is taking such a firm stand. Accordingly JCM (Staff Side) has submitted a letter to the Government (DoP&T) to include GDS in the terms of reference of 7thCPC. The matter is now pending before the Government for a decision. NFPE & FNPO and the GDS unions of NFPE (AIPEU-GDS-NFPE) and FNPO (NUGDS) has conducted two days nationwide strike demanding inclusion of GDS in the terms of reference of 7th CPC. Both NFPE & FNPO has already declared that they will jointly go for an indefinite strike, if the demand for inclusion of GDS under the 7th CPC is not accepted by the Government.

But to our shock and surprise, the recognised GDS Union leading by Mahadevaiah has signed an agreement with the Postal Board agreeing for the appointment of a separate committee for GDS. No Unions/Federations including Mahadevaiah’s union have demanded a separate committee (either Judge Committee or Bureaucratic Committee) in their charter of demands submitted to the Government and the Department of Posts. The 7th Pay Commission is appointed for Central Government Employees (Civil Servants). Separate Committee (even if it is a separate Judge) means GDS are not civil servants and they are only Extra-Departmental. Why should Mahadevaiah accept such a stand of the Department and Government? Earlier also one separate committee of Retired Judge (Justice Talwar Committee) was appointed for GDS. But even now GDS are Extra-Departmental and not treated as Civil Servants. Inclusion in 7th CPC means Government accepting our demand that GDS are Government employees (Civil Servants) and their service conditions and wage structure will be examined and recommended by 7th CPC along with other Central Government Employees. Thus a century long discrimination towards GDS shall come to an end. Even Justice Talwar Committee has recommended that in future, no separate committe (either Judge or Bureaucratic) should be appointed for the GDS and they should be included in Pay Commissions itself. By accepting a separate Committee, Mahadevaiah has spoiled the entire future of GDS.

By signing an agreement with the Postal Board, the Recognised GDS Union (Mahadevaiah) has signed the Death Warrant of the 2.76 lakhs Gramin Dak Sevaks. He has played a drama with the Postal Board and Government and cheated GDS and defeated the very purpose of the united stand taken by all the JCM Staff side organizations. Postal Board has cleverly managed Mahadevaiah to sign an agreement itself.

Normally after discussions with the unions, minutes are signed and copy given to unions. In this case, the Postal Board was very particular to get an agreement signed by the Recognised Union (Mahadevaiah) so that he cannot go back from the agreement in future. Ironically, for all other demands raised by Mahadevaiah in his Charter of Demands only separate minutes is given by the Department. Departmental officers and DoP&T are very intelligent and shrewd and they obtained what they want  …. !!!

When Recognised union signed an agreement, tomorrow the Government will say to the staff side that as the recognised union has already agreed for a separate committee, we are not including GDS in the 7th CPC. Thus, the Recognised Union of the GDS (Mahadevaiah) has become an agent of the Government. As already stated by us, Postal Board and the Government have succeded in their game of “Divide and Rule”. That is why Mahadevaiah has not joined the joint strike of two days conducted by NFPE, FNPO and the GDS union of NFPE (AIPEU-GDS-NFPE) and FNPO (NUGDS) on 12th & 13th February 2014. In the coming days the hidden agenda behind the separate strike held by Mahadevaiah and the agreement will come out with more clear.

The Department and the Government always used to told NFPE & FNPO that by appointing a separate committee (either Judge or Bureaucratic) GDs will be much benefited. They have compelled NFPE & FNPO to accept separate Committee. We rejected the offer of the Government & the Department as we are well aware, from our past experience, the danger behind it and also the hidden agenda of the Government & the Department. Finally after the two days strike the Secretary, Department of Posts has given us a letter informing that our demand for inclusion of GDS in Seventh Pay Commission is referred to Government (DoP&T) for a decision. The Government understood that when the entire JCM staff side has taken a firm united stand, it will be very difficult for them to reject our demand. They wanted to pre-empt the united stand of the staff side.That is why the indefinite strike drama was played (eventhough participation was very less) and finally an agreement was signed behind the curtain and declaring that this is a greatest achievement (!) and this is a first step towards the liberation of GDS (!!!), as if there was no separate Judge Committee (Talwar Committee) appointed by Government . It proved beyond doubt that both the Recognised Union (Mahadeviah) and the Government want to keep the GDS always outside the Pay Commission and always as “extra-departmental employees”.earlier

NFPE and FNPO and the GDS Unions of NFPE (AIPEU-GDS-NFPE) and FNPO (NUGDS) strongly condemn and protest the anti-GDS agreement signed by the Postal Board and the Recognised Union (Mahadevaiah) and we demand the Government to include the GDS in the terms of reference of the 7th CPC itself instead of a separate Committee (Whether Judge or Bureaucrat). We call upon the entire Postal and RMS employees including Gramin Dak Sevaks to recognise the danger behind the agreement and expose those who signed the agreement which is nothing but a…

We further call upon the entire employees to conduct protest demonstration all over India on 26.02.2014 in front of all important offices against the stand taken by the Postal Board and demanding to remit the GDS issues in the purview of the Seventh Pay Commission.

PAYMENT OF COMMISSION TO POST OFFICES & COOPERATIVE BANKS FOR DIRECT BENEFIT TRANSFER

NFPE LEADERS DISCUSSION WITH SECRETARY, DEPT. OF POSTS TODAY


DISCUSSION WITH SECRETARY, DEPARTMENT OF POSTS
Today Com. M. Krishnan, Secretary General, NFPE held discussion with Secretary, Department of Posts. Com. K. V. Sridharan, Ex-General Secretary, P3 (CHQ) and Com. Balwinder Singh, Financial Secretary, P3 (CHQ) were also present. Mainly two issues were discussed.

(1)   GDS issues            
(2)   IT Modernisation Project & Recruitment

  GDS Issues

Regarding GDS issue Secretary, Department of Posts said that as already informed to the Federations, inclusion under the purview of 7th Pay Commission can be considered and decided by Govt. (DOP&T) only. Hence whether GDS shall be included under 7th CPC or separate committee is to be appointed is to be decided by the Government. Secretary, Department of Posts can only refer the matter to Government and cannot take any decision in this matter. 

We told that accepting any other separate committee (Whether Judicial or Retired officer) will be equal to accepting the argument of the Government and Department that “GDS are not Civil Servants and hence they cannot be included in the 7th Pay Commission”.

The JCM Staff side, National Council has already taken a stand that GDS should be included under the purview of 7th Pay Commission itself. Further Confederation of Central Government Employees & Workers & NFPE have conducted a two days strike for inclusion of GDS under 7th CPC. FNPO also conducted two days strike on the same demands. 

No Unions/Federations in the Postal Department or in the National Council JCM has demanded a separate committee for GDS, whether Judicial or Bureaucratic. Accepting any other Committee will be equal to accepting the stand of the Government that GDS are not Civil Servants. 

When NFPE & AIPEU-GDS (NFPE) have challenged the stand of the Government that “GDS are not civil servants” in the Hon’ble Supreme Court and when the Delhi High Court has already issued notice to the Department, accepting a separate Committee and thereby accepting the stand of the Government that GDS are not civil servants and hence cannot be included in the 7th CPC will be suicidal at this point of time, as far as GDS are concerned. 

We made our position very clear. If the UPA Government is not ready to accept our stand, we will place our demand before the next Government and go for indefinite strike. Hence our decision for indefinite strike after election stands.

   IT Modernisation Project

While extending our cooperation for the implementation of the project, we brought the difficulties being faced by the employees due to the hasty implementation of CBS, malfunctioning of some software etc. for immediate redressal. 

Secretary, Posts, informed that 10200 recruitment in PA cadre is going to take place and assured that the difficulties pointed out by the staff side will be taken care of and addressed.
